TERMS OF SERVICE

Preamble

These Terms of Service (hereinafter "ToS") govern access to and use of the DOMOD platform (hereinafter "the Platform"), published by:

By accessing the Platform and creating an account, you fully accept these ToS. If you do not accept these terms, you must not use the Platform.

1. Definitions

 

"DOMOD": refers to DOMOD SAS, publisher of the Platform.
"Platform": refers to all online services accessible at https://www.domod.build/ and the associated application.
"User": refers to any individual or legal entity accessing the Platform, whether for professional (B2B) use or as an independent artisan or individual consumer (B2C).
"Customer": refers to any User who has subscribed to a paid plan.
"Account": refers to the personal space created by the User upon registration.
"Content": refers to all data, information, texts, images, documents and files uploaded or generated by the User on the Platform.
"Subscription": refers to the pricing plan subscribed to by the Customer.
"Services": refers to all features offered by the Platform.

2. Description of Services

 

DOMOD is a SaaS platform for construction and renovation project management, enabling:

 

  • Creation and monitoring of projects and worksites

  • Task, document and estimate management

  • Centralisation of communications and project history

  • Production of professional documents (quotes, purchase orders, etc.)

  • Access to additional features depending on the subscription plan

 

Services are accessible from any compatible web browser and/or the DOMOD mobile app.

3. Account Registration and Access

 

3.1 Eligibility
Access to the Platform is open to:

 

  • Legal entities (companies, associations, etc.) represented by an authorised representative;

  • Adult natural persons acting in a professional capacity (artisans, sole traders, freelancers, etc.);

  • Adult natural persons acting in a personal capacity (where Services are compatible with non-professional use).

 

The User declares having the legal capacity required to enter into these ToS.

 

3.2 Registration
Registration is carried out online at https://www.domod.build/. The User undertakes to provide accurate, complete and up-to-date information and to keep it so throughout the use of the Platform.


3.3 Account Security
The User is solely responsible for the confidentiality of their login credentials and undertakes to notify DOMOD immediately of any unauthorised use of their account at info@domod.build.

4. Financial Terms

 

4.1 Free Trial
DOMOD may offer a free trial period whose terms are specified on the Platform at the time of registration.

 

4.2 Subscription Plans
Access to the full Services is subject to a paid subscription. Available plans, included features and prices are presented on the pricing page at https://www.domod.build/. DOMOD reserves the right to modify pricing, subject to prior notice to Customers.

 

4.3 Billing and Payment

 

  • Subscriptions are billed monthly or annually, at the Customer's choice.

  • Payments are processed by Stripe Payments Europe, Ltd., a PCI-DSS certified payment provider.

  • Annual subscriptions are charged in full on the subscription date.

  • Monthly subscriptions are charged each month on the subscription anniversary date.

  • All amounts are quoted in euros (EUR) exclusive of tax. Applicable VAT will be added in accordance with applicable regulations.

 

4.4 Automatic Renewal
Subscriptions renew automatically at expiry. The Customer may disable automatic renewal from their account settings before the renewal date.

 

4.5 Late Payment
In the event of payment default, DOMOD reserves the right to suspend access to Services after notification, and to terminate the subscription if the default is not remedied within thirty (30) days.

 

4.6 Refunds
Except as otherwise required by law, amounts paid are non-refundable. Users who qualify as consumers under applicable law (in particular artisans and individuals acting outside their main professional activity) have a right of withdrawal of fourteen (14) days from the date of subscription, provided that performance of the service has not commenced with the User's express agreement.

5. Additional Features

 

Certain supplementary features may be subscribed to as add-ons, outside the main subscription plan. These are governed by the Conditions for Additional Features available

 

6. Acceptable Use

 

The User undertakes to use the Platform in accordance with its purpose and these ToS, and in particular agrees not to:

 

  • Use the Platform for unlawful, fraudulent or contrary to public order purposes;

  • Infringe the rights of third parties (intellectual property rights, privacy, etc.);

  • Attempt unauthorised access to DOMOD's or other Users' systems or data;

  • Introduce viruses, trojans or any other malicious code;

  • Scrape, extract or copy Platform data for commercial purposes without DOMOD's prior written authorisation;

  • Use the Platform in a way that places excessive load on servers;

  • Resell or sublicense access to the Platform without DOMOD's prior written consent.

7. User Content

 

7.1 Ownership
The User retains full ownership of all Content they upload or generate on the Platform.

 

7.2 Licence Granted to DOMOD
To provide the Services, the User grants DOMOD a non-exclusive, worldwide, royalty-free licence to use, reproduce, store and process their Content, strictly limited to the provision of the Services and improvement of the Platform.


7.3 Content Responsibility
The User is solely responsible for their Content and indemnifies DOMOD against any claim, action or liability arising from unlawful Content or Content that infringes third-party rights.

 

8. DOMOD's Intellectual Property

 

The Platform, its source code, architecture, interfaces, databases, trademarks, logo and all its constituent elements are the exclusive property of DOMOD SAS or its licensors and are protected by intellectual property law. Any unauthorised reproduction, representation, adaptation or exploitation is prohibited.

 

9. Availability and Maintenance

 

DOMOD endeavours to provide 24/7 availability of the Platform but cannot guarantee uninterrupted availability. Scheduled maintenance may be carried out, preferably outside peak hours, with advance notice where possible. DOMOD shall not be liable for interruptions due to external causes (infrastructure failures, force majeure, etc.).

10. Limitation of Liability

 

To the extent permitted by law:

 

  • DOMOD provides the Platform "as is" and makes no warranty that it will be free from errors or perfectly suited to each User's specific needs.

  • DOMOD shall not be liable for indirect, consequential or intangible damages (data loss, loss of profit, loss of business opportunity) arising from the use or inability to use the Platform.

  • DOMOD's total liability, for any reason whatsoever, is limited to the amounts actually paid by the Customer in the twelve (12) months preceding the event giving rise to the damage.

 

These limitations do not apply in cases of DOMOD's gross negligence or wilful misconduct, or where prohibited by law, including with respect to consumers.
 

11. Personal Data

 

The processing of Users' personal data is described in our privacy policy available at https://www.domod.build/privacy-policy.

 

12. Term and Termination

12.1 Term
These ToS are concluded for an indefinite period, from the date of account creation.

 

12.2 Termination by the User
The User may terminate their account at any time from their account settings or by contacting info@domod.build. Termination takes effect at the end of the current subscription period.

 

12.3 Termination by DOMOD
DOMOD may suspend or terminate access to the Platform in the event of a breach of these ToS, after formal notice remaining unanswered for fifteen (15) days, except in cases of serious breach justifying immediate termination.


12.4 Effects of Termination
Upon the effective date of termination, the User loses access to their account. Their Content is retained for a period of thirty (30) days, during which the User may request an export, then permanently deleted.


 

13. Amendments

 

DOMOD reserves the right to modify these ToS at any time. In the event of material changes, Users will be notified by email or notification on the Platform, with at least thirty (30) days' notice. Continued use of the Platform after this period constitutes acceptance of the new ToS.

 

14. General Provisions

 

14.1 Governing Law
These ToS are governed by French law.

 

14.2 Dispute Resolution
In the event of a dispute between DOMOD and a business User, the parties undertake to seek an amicable solution before taking legal action. Failing agreement within thirty (30) days, the dispute shall be submitted to the competent courts of Paris.

 

For Users who qualify as consumers, it is noted that in accordance with applicable consumer protection law, any consumer has the right to use a free consumer mediation service.

 

14.3 Language
In the event of contradiction between translated versions of these ToS and the French version, the French version shall prevail.

 

14.4 Entire Agreement
These ToS constitute the entire agreement between the parties regarding their subject matter.


14.5 Severability
If any provision of these ToS is declared void or unenforceable, the remaining provisions shall remain in force.
